đâïž What is covered by my Landlord's Building Insurance during a storm? âĄ
⥠Basically, the structure, to include walls, roof, and windows đ
⥠Most policies will not cover outside areas, such as fences, sheds, or gates unless specifically requested đ«
⥠Insurance companies may require you to provide evidence that the roof etc, has been well maintained đ
đâïž Do I have to repair and fix fences/gates if they are blown down?
⥠Actually, it does NOT fall under the Landlord’s Statutory Obligation (Section 11 of the Landlord and Tenant Act 1985) đ€
⥠However, if your Tenant complained to the local council, its highly likely they would request its repaired/replaced under the 'Housing Health and Safety Rating System' (HHSRS) â

⥠If your property is a House of Multiple Occupation (HMO), you do have a legal duty under the HMO Management Regulations 2006, to maintain and keep in repair the outside areas đ§đ§°
đâïž Can tenants make a claim against my Landlord’s Building Insurance for damage to their personal possessions?
⥠No, Tenants’ possessions are never covered under your building insurance đ€
⥠However, if the Tenant can prove negligence i.e. the roof was in a state of disrepair, or the window did not close properly before the storm, they could make a civil claim against you as the Landlord đ©âïž
đâïž A neighbour has claimed that a roof tile or fence panel has caused damage to their car or property - can they make a claim against you?
⥠As a general rule, no â
⥠If they can prove negligence i.e. the items were in a bad state of repair before the storm, they could potentially take out a civil claim against you â
⥠In most cases, the advice would be for the neighbour to make a claim against their own insurance policy and let the insurance company do the investigating/chasing of how they get paid (if they believe there to be negligence by a third party) đ°
